If you are found guilty or plead guilty to a charge then the Sheriff will have a number of options available. He can impose a custodial sentence or a fine or sentence can be deferred.

Sentence can be deferred for a number of reasons but the most common reason for deferring sentence is to allow the Sheriff to obtain a Criminal Justice Social Work Report. This is a report that is compiled by the Social Work Department after an interview with you and this provides the Sheriff with detailed information of your background including your education and employment record, your personal circumstances and your income. Importantly, the report also advises the Sheriff of your attitude towards the offence and gives a recommendation as to how the Sheriff should deal with the case so it is essential that you co-operate with the author of this report, express your remorse and put yourself across in a positive light.

Failure to co-operate with the preparation of this report can result in imprisonment so it is important not to miss interviews with the Social Work Department. However, if you do miss an appointment or have difficulty attending, contact us and we shall contact the Social Work Department on your behalf to ensure that the reports are prepared.
