Potential Loopholes
- Insufficient calibration or testing of speed detection equipment.
- Insufficient measurement of roads used for calibrating and testing equipment.
- Insufficient evidence of speed limit, identity of driver or vehicle registration mark.
- Failure by police officers to follow procedures.
- Unauthorised police officers conducting enquiries under Section 172 of the RTA 1988.

Scotland’s Road Traffic Policing Departments use various speed detection devices such as the Prolaser III, VASCAR and the Unipar Laser while maintaining both stationary and average speed cameras.
It is essential that these devices are not only working properly but that they are tested and operated in accordance with procedures otherwise the recordings taken can be inaccurate or simply unreliable.
Penalties for this offence include a fine and the imposition of penalty points, normally between 3-6 points. However, were the speed is deemed excessive disqualification is a possibility.
Unfortunately, with so many static and mobile speed detection devices it can be easy to rack up penalty points and be faced with disqualification through totting up.
