Dangerous Dogs & Animal Welfare

Dangerous Dogs & Animal Welfare Solicitors Glasgow & Hamilton

There is a range of legislation used to deal with the welfare of animals and in particular the control of dogs. The principal legislation referred to is the: –

  • Dangerous Dogs Act 1991;
  • Control of Dogs (Scotland) Act 2010; and
  • Animal Health and Welfare (Scotland) Act 2006.

We advise a range of clients in relation to potential offences under the legislation as sometimes the unintended consequences of pet, and in particular dog ownership can leave families including persons in temporary charge of dogs at the relevant time, susceptible to criminal prosecution if the dog is considered to be out of control.

Section 3 – of the Dangerous Dogs Act 1991 – Keeping dogs under proper control states: –

(1) If a dog is dangerously out of control in any place (whether or not a public place)—

(a) the owner; and

(b) if different, the person for the time being in charge of the dog, is guilty of an offence, or, if the dog while so out of control injures any person, an aggravated offence, under this subsection.

Section 4 further deals with destruction and disqualification orders.

We know how distressing it can be if your loved animal is taken from you and faces potentially permanent seizure, kennelling or destruction. A disqualification order can also be extremely onerous whereby you are excluded from owning a dog for a number of years. We strive to represent our clients and work with expert dog therapists and dog behaviourists to defend these cases to achieve the best possible results for the owner and their respective families.
