A Guardianship Order is an order of the Court which appoints an individual to make certain decisions on behalf of another who is not able to do so for themselves. Essentially, when someone is unable to look after themselves and does not have a Power of Attorney in place, the next step is for loved ones to apply for a Guardianship Order from the court. The appointed Guardian effectively has the same powers as an Attorney would, which allows them to look after both the financial and welfare decisions of an adult with incapacity. Different people can be appointed for financial and welfare decisions and appointments can also be made on a joint basis.
