Guardianship Orders

A Guardianship Order is an order of the Court which appoints an individual to make certain decisions on behalf of another who is not able to do so for themselves.  If you think you are in the position where a Guardianship Order is required, we advise that you seek expert legal advice at the earliest opportunity.

Essentially, when someone is unable to look after themselves and does not have a Power of Attorney in place, the next step is for loved ones to apply for a Guardianship Order from the court. The appointed Guardian effectively has the same powers as an Attorney would, which allows them to look after both the financial and welfare decisions of an adult with incapacity. Different people can be appointed for financial and welfare decisions and appointments can also be made on a joint basis.

The Guardianship process requires a court application to be made which must be supported by a number of reports confirming incapacity and the suitability of the proposed guardian. These reports will include opinions from medical professionals and medical health personnel from your local council or social work department.
