Often, the laws of the country where an asset is held will determine how that asset is dealt with, which can make assets abroad challenging to deal with.

If a deceased person left a Will, this may make provision for dealing with any foreign assets they had. However, in most cases where property was held abroad, there will likely be a foreign Will (in addition to the Scottish Will). This is because each country’s laws are different when it comes to dealing with estates.
If there was no Will left at all, any property held abroad will be dealt with in accordance with that country’s laws. We work with solicitors across the world who can easily advise on the specific rules of the appropriate country.
